GENERAL TERMS AND CONDITIONS OF SALE

 

The site www.conceriaopera.it is owned by OPERA SRL (hereinafter also “Opera”) with registered office in Via Emilia Romagna, 6, 56029 Santa Croce sull’Arno (PI), Italy, VAT number IT01970310502.

Opera SRL is registered in the business register of Pisa, registration number REA FI-169904.

The products on the above mentioned web sites are produced and sold by OPERA S.R.L. The name OPERA SRL will be present on the order confirmation and in the payment confirmation.

Opera SRL is responsible for the sales, including the delivery, customer management and any complaints as outlined in these Terms and Conditions.

Contract

With the Contract finalized through the online order, the sales of the product(s) offered on Opera Website will be governed by these Terms and Conditions.

Opera products can be viewed by accessing the Website https://conceriaopera.it/shop/

Products are represented accurately on the Website, with their relevant characteristics highlighted, and are accompanied by a description in the form of an information sheet.

For the purposes of the exact description of the product being sold, in case of discrepancies between the image of the products published on the Site and the relevant information sheet, the latter shall prevail.

The publication of products online represents an invitation to place an offer addressed to customers so that they formulate a purchase proposal.

Opera will send an order confirmation to the customer as soon as possible.

The order confirmation represents an acknowledgement of receipt and does not constitute acceptance of the purchase proposal; the acceptance must be expressly forwarded by Opera and may also be sent by separate and subsequent communication.

Opera has the right to accept, or not, the order sent by the customer without the latter being able to make any claims in this regard, except for the return of any amounts paid in the meantime.

 

Online catalog and availability of goods

Opera will handle, via computer system, the processing and fulfillment of the order without delay, according to the procedures adopted.

The online catalog shall list both available and unavailable products, as well as the estimated time of shipment.

Should it not be possible to process the order for any reason, Opera will notify the purchaser by email without delay – (the customer shall provide their contact email address at the time of the order) – possibly informing them of the estimated time needed for the order processing or the definite inability to deliver the goods, in which case the customer will be refunded any amount paid.

Shipping

After adding correctly all the items to the shopping cart and prior to the conclusion of the purchase, the customer will be asked to enter a complete shipping address in its entirety.

Shipping costs for the order as well as any other incidental costs (including any customs clearance charges), are excluded from the price and will be calculated based on the weight, size and country of shipment of the order.

Most products are immediately available or pre-ordered

If available, the products ordered will be shipped the day after the order is placed and upon receipt of payment of due amount.

The estimated delivery time – for Italy: within 24/72h from the receipt of the order; – for Europe and the rest of the world: from 3 to 14 days from the receipt of the order;

Generally in Europe, the goods are delivered in 3-5 days.

Prices

The prices listed on www.conceriaopera.it are VAT included.

The shipping costs of the order as well as any other additional costs (including customs clearance charges), are not included in the price and will be calculated according to the weight, size and country of shipment of the order.

 

Payments

Opera tannery uses Stripe as a third-party vendor to process payments made by credit card.

Stripe is considered one of the most reliable and authoritative credit card financial transaction processors.

The customer’s credit card information will be transferred securely through SSL (Secure Sockets Layer protocol), which will automatically encrypt all payment transaction information. The credit card data will not be stored on Opera Tannery’s servers and therefore it will not be able to read in any way the information sent through the web.

  • Apple Pay
  • Google Pay

 

Billing

The summary of your order with the total cost will be sent along with the goods inside the package.

Online sales of products through the Internet with shipment of the goods by carrier or freight forwarders are similar to mail order sales.

Therefore, the provision contained in Article 22, c 1 of Presidential Decree 633/1972 that provides exemption from the obligation to issue a receipt or tax receipt is applicable.

Opera tannery is not responsible for the non-execution or delayed execution of the Contract if this is due to inefficiencies attributable to force majeure, fortuitous event, or otherwise to other circumstances not attributable to the supplier.

Opera tannery assumes no liability for any fraudulent, illegal or irregular use of credit cards, checks or other means of payment, attributable to willful or negligent conduct of the customer with respect to the obligations of custody and timely information to the issuer of the aforementioned means of payment.

 

Right of withdrawal

The customer may withdraw from the contract within 14 days after delivery of the product, without any obligation to explain the reasons.

In case of withdrawal the nominal price of the products covered by the order will be refunded upon return of the products to the headquarters of Opera Tannery (excluding any additional costs); the refund will be processed after it is verified that the product is intact, free of scratches, nicks, signs of wear or other alterations compared to the condition of the goods at the time of shipment to the customer. This verification will condition, in whole or in part, the refund of the price according to an assessment of relevance of Opera.

In order to withdraw from the contract, the customer must submit an explicit statement, within the period provided above, to the following e-mail address: marketing@conceriaopera.it

The refund will be processed using the same method of payment used by the Customer, unless the Customer has expressly requested a different method.

This refund may be suspended until the receipt of goods. The customer shall be responsible for the freight costs.

Jurisdiction and competent court

Any dispute related to the validity, effectiveness, execution, interpretation and breach of the purchase contracts entered into online through the website www.conceriaopera.it is subject to Italian jurisdiction.

Any dispute between the customer and Opera S.R.L. shall be resolved before the competent court of the customer’s district of residence or domicile, before referring to the aforementioned judicial authority, they will have the option of using the conciliation service governed by the regulations of the Conciliation Service of the Chamber of Commerce of Pisa.

For any matters not expressly provided for herein, reference is made to the regulations of the Italian Civil Code, the Consumer Code and the regulations on the sale of products online, with the prevalence of the aforementioned regulations over this contract where the law establishes their mandatory nature.
